各(ge)省、自治區、直(zhi)轄(xia)市人民政府,國務院各(ge)部(bu)委、各(ge)直(zhi)屬機構:


  建(jian)筑(zhu)(zhu)(zhu)業(ye)是國(guo)民(min)經(jing)(jing)濟的支(zhi)柱產(chan)業(ye)。改(gai)革開(kai)放(fang)以來(lai),我國(guo)建(jian)筑(zhu)(zhu)(zhu)業(ye)快速(su)發(fa)(fa)展(zhan),建(jian)造能力(li)(li)不(bu)斷增(zeng)強,產(chan)業(ye)規(gui)模不(bu)斷擴大(da),吸納了大(da)量農(nong)村轉(zhuan)移勞(lao)動(dong)力(li)(li),帶動(dong)了大(da)量關聯產(chan)業(ye),對經(jing)(jing)濟社會發(fa)(fa)展(zhan)、城(cheng)鄉(xiang)建(jian)設和民(min)生(sheng)改(gai)善作出(chu)了重(zhong)要(yao)貢獻。但也(ye)要(yao)看到(dao),建(jian)筑(zhu)(zhu)(zhu)業(ye)仍然大(da)而不(bu)強,監管(guan)體(ti)制(zhi)機(ji)制(zhi)不(bu)健全、工(gong)程建(jian)設組(zu)織方(fang)式落(luo)后、建(jian)筑(zhu)(zhu)(zhu)設計水平有(you)待提(ti)高、質量安全事故時有(you)發(fa)(fa)生(sheng)、市(shi)場違法違規(gui)行為較多、企業(ye)核心競(jing)爭力(li)(li)不(bu)強、工(gong)人技能素質偏(pian)低(di)等問題較為突(tu)出(chu)。為貫徹落(luo)實《中共中央 國(guo)務院關于進(jin)一(yi)(yi)步加(jia)強城(cheng)市(shi)規(gui)劃(hua)建(jian)設管(guan)理工(gong)作的若干意(yi)見》,進(jin)一(yi)(yi)步深化建(jian)筑(zhu)(zhu)(zhu)業(ye)“放(fang)管(guan)服”改(gai)革,加(jia)快產(chan)業(ye)升(sheng)級,促進(jin)建(jian)筑(zhu)(zhu)(zhu)業(ye)持續健康發(fa)(fa)展(zhan),為新(xin)型城(cheng)鎮化提(ti)供支(zhi)撐(cheng),經(jing)(jing)國(guo)務院同意(yi),現提(ti)出(chu)以下意(yi)見:


  一、總體要求


  全(quan)(quan)面(mian)貫(guan)徹黨(dang)的十八大和十八屆(jie)二中(zhong)(zhong)(zhong)(zhong)(zhong)、三中(zhong)(zhong)(zhong)(zhong)(zhong)、四中(zhong)(zhong)(zhong)(zhong)(zhong)、五中(zhong)(zhong)(zhong)(zhong)(zhong)、六中(zhong)(zhong)(zhong)(zhong)(zhong)全(quan)(quan)會以(yi)及(ji)中(zhong)(zhong)(zhong)(zhong)(zhong)央(yang)(yang)經濟工作會議(yi)、中(zhong)(zhong)(zhong)(zhong)(zhong)央(yang)(yang)城(cheng)鎮化(hua)工作會議(yi)、中(zhong)(zhong)(zhong)(zhong)(zhong)央(yang)(yang)城(cheng)市工作會議(yi)精(jing)神(shen),深入貫(guan)徹習近平總書(shu)記(ji)系列(lie)重要講話(hua)精(jing)神(shen)和治國(guo)理政新(xin)理念(nian)新(xin)思想新(xin)戰(zhan)略,認真落實黨(dang)中(zhong)(zhong)(zhong)(zhong)(zhong)央(yang)(yang)、國(guo)務院決策部署(shu),統(tong)籌推進(jin)“五位一體(ti)”總體(ti)布局和協調推進(jin)“四個全(quan)(quan)面(mian)”戰(zhan)略布局,牢固樹立和貫(guan)徹落實創新(xin)、協調、綠色(se)、開放、共(gong)享的發展理念(nian),堅持(chi)以(yi)推進(jin)供給側結構性改(gai)革為(wei)主線,按照適(shi)用、經濟、安全(quan)(quan)、綠色(se)、美觀的要求(qiu),深化(hua)建(jian)筑業“放管(guan)服”改(gai)革,完(wan)善監管(guan)體(ti)制(zhi)機(ji)制(zhi),優化(hua)市場環境,提升工程質量安全(quan)(quan)水(shui)平,強(qiang)化(hua)隊伍建(jian)設,增強(qiang)企(qi)業核心競爭力,促進(jin)建(jian)筑業持(chi)續健康發展,打造“中(zhong)(zhong)(zhong)(zhong)(zhong)國(guo)建(jian)造”品牌。


  二(er)、深化建筑業簡政放(fang)權改革


  (一(yi))優化(hua)資質(zhi)資格管理。進一(yi)步簡化(hua)工程建(jian)設企業(ye)資質(zhi)類(lei)別(bie)和等級設置,減少不必(bi)要(yao)的(de)資質(zhi)認定。選(xuan)擇(ze)部分地區開展試點,對信用良(liang)好、具有(you)相關專(zhuan)業(ye)技術(shu)能(neng)(neng)力、能(neng)(neng)夠(gou)提(ti)供足(zu)額擔(dan)(dan)保(bao)的(de)企業(ye),在其資質(zhi)類(lei)別(bie)內放寬承攬業(ye)務(wu)(wu)范(fan)圍限制,同時,加快完善信用體系、工程擔(dan)(dan)保(bao)及個(ge)人(ren)執(zhi)業(ye)資格等相關配(pei)套(tao)制度(du),加強事(shi)中事(shi)后監管。強化(hua)個(ge)人(ren)執(zhi)業(ye)資格管理,明晰注冊執(zhi)業(ye)人(ren)員的(de)權(quan)利(li)、義務(wu)(wu)和責任,加大執(zhi)業(ye)責任追究力度(du)。有(you)序(xu)發展個(ge)人(ren)執(zhi)業(ye)事(shi)務(wu)(wu)所,推動(dong)建(jian)立個(ge)人(ren)執(zhi)業(ye)保(bao)險制度(du)。大力推行(xing)“互聯網+政(zheng)務(wu)(wu)服務(wu)(wu)”,實(shi)行(xing)“一(yi)站式”網上審批(pi),進一(yi)步提(ti)高建(jian)筑領(ling)域行(xing)政(zheng)審批(pi)效率(lv)。


  (二)完(wan)善招(zhao)(zhao)標(biao)(biao)投標(biao)(biao)制度。加快修訂《工(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)項(xiang)(xiang)(xiang)目(mu)(mu)招(zhao)(zhao)標(biao)(biao)范圍和規(gui)模標(biao)(biao)準規(gui)定(ding)》,縮(suo)小并(bing)嚴格(ge)界定(ding)必須進(jin)行(xing)招(zhao)(zhao)標(biao)(biao)的工(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)項(xiang)(xiang)(xiang)目(mu)(mu)范圍,放寬有關規(gui)模標(biao)(biao)準,防止工(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)項(xiang)(xiang)(xiang)目(mu)(mu)實行(xing)招(zhao)(zhao)標(biao)(biao)“一刀切(qie)”。在(zai)民間投資的房(fang)屋建(jian)(jian)筑工(gong)(gong)程(cheng)(cheng)中,探(tan)索由建(jian)(jian)設(she)單(dan)(dan)位(wei)自主決定(ding)發包方式。將(jiang)依(yi)法(fa)必須招(zhao)(zhao)標(biao)(biao)的工(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)項(xiang)(xiang)(xiang)目(mu)(mu)納入統一的公(gong)(gong)共資源交(jiao)(jiao)易平(ping)臺,遵循公(gong)(gong)平(ping)、公(gong)(gong)正、公(gong)(gong)開和誠(cheng)信的原(yuan)則,規(gui)范招(zhao)(zhao)標(biao)(biao)投標(biao)(biao)行(xing)為。進(jin)一步簡化招(zhao)(zhao)標(biao)(biao)投標(biao)(biao)程(cheng)(cheng)序,盡快實現招(zhao)(zhao)標(biao)(biao)投標(biao)(biao)交(jiao)(jiao)易全過程(cheng)(cheng)電子(zi)化,推(tui)行(xing)網上異地評(ping)標(biao)(biao)。對依(yi)法(fa)通過競爭性談(tan)判或(huo)單(dan)(dan)一來源方式確定(ding)供應(ying)商的政府采購工(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)項(xiang)(xiang)(xiang)目(mu)(mu),符合(he)相應(ying)條件(jian)的應(ying)當(dang)頒發施(shi)工(gong)(gong)許可(ke)證。


  三(san)、完善工程(cheng)建設(she)組織模式(shi)


  (三)加快(kuai)推(tui)行(xing)工(gong)(gong)程(cheng)(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)。裝(zhuang)配(pei)式(shi)建筑原(yuan)則上應(ying)采用工(gong)(gong)程(cheng)(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)模(mo)式(shi)。政府投資工(gong)(gong)程(cheng)(cheng)應(ying)完善建設(she)管理模(mo)式(shi),帶(dai)頭(tou)推(tui)行(xing)工(gong)(gong)程(cheng)(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)。加快(kuai)完善工(gong)(gong)程(cheng)(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)相關(guan)的招(zhao)標(biao)(biao)(biao)投標(biao)(biao)(biao)、施工(gong)(gong)許可、竣(jun)工(gong)(gong)驗收(shou)等制度規定。按照總(zong)(zong)承(cheng)(cheng)包(bao)(bao)負總(zong)(zong)責的原(yuan)則,落實工(gong)(gong)程(cheng)(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)單位在工(gong)(gong)程(cheng)(cheng)質(zhi)量安全、進度控制、成本管理等方(fang)面的責任。除以暫(zan)估價(jia)形式(shi)包(bao)(bao)括在工(gong)(gong)程(cheng)(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)范圍內且依法必須進行(xing)招(zhao)標(biao)(biao)(biao)的項目外,工(gong)(gong)程(cheng)(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)單位可以直接發包(bao)(bao)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)合同中涵蓋的其他專業業務(wu)。


  (四)培育全(quan)(quan)過(guo)(guo)程(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)咨(zi)詢(xun)(xun)(xun)。鼓勵投(tou)資咨(zi)詢(xun)(xun)(xun)、勘察、設計、監理(li)、招標代理(li)、造價等企業采取聯合經營、并購重組等方(fang)式發展全(quan)(quan)過(guo)(guo)程(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)咨(zi)詢(xun)(xun)(xun),培育一批具有(you)國際水(shui)平的全(quan)(quan)過(guo)(guo)程(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)咨(zi)詢(xun)(xun)(xun)企業。制定全(quan)(quan)過(guo)(guo)程(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)咨(zi)詢(xun)(xun)(xun)服(fu)務技(ji)術標準和(he)合同范(fan)本。政(zheng)府投(tou)資工(gong)程(cheng)(cheng)(cheng)應帶(dai)頭推行全(quan)(quan)過(guo)(guo)程(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)咨(zi)詢(xun)(xun)(xun),鼓勵非(fei)政(zheng)府投(tou)資工(gong)程(cheng)(cheng)(cheng)委托(tuo)全(quan)(quan)過(guo)(guo)程(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)咨(zi)詢(xun)(xun)(xun)服(fu)務。在民(min)用(yong)(yong)建(jian)筑項目中,充(chong)分發揮建(jian)筑師的主導作用(yong)(yong),鼓勵提(ti)供全(quan)(quan)過(guo)(guo)程(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)咨(zi)詢(xun)(xun)(xun)服(fu)務。


  四、加強(qiang)工程質量安(an)全管(guan)理(li)


  (五)嚴(yan)格落實工(gong)(gong)(gong)程質(zhi)(zhi)量(liang)(liang)責(ze)(ze)(ze)(ze)任(ren)。全面落實各方主(zhu)(zhu)體的(de)工(gong)(gong)(gong)程質(zhi)(zhi)量(liang)(liang)責(ze)(ze)(ze)(ze)任(ren),特別要(yao)強化建(jian)設(she)單位(wei)(wei)(wei)的(de)首(shou)要(yao)責(ze)(ze)(ze)(ze)任(ren)和勘察(cha)、設(she)計、施工(gong)(gong)(gong)單位(wei)(wei)(wei)的(de)主(zhu)(zhu)體責(ze)(ze)(ze)(ze)任(ren)。嚴(yan)格執(zhi)行工(gong)(gong)(gong)程質(zhi)(zhi)量(liang)(liang)終(zhong)身責(ze)(ze)(ze)(ze)任(ren)制,在(zai)建(jian)筑物明顯部位(wei)(wei)(wei)設(she)置永久性標牌,公示(shi)(shi)質(zhi)(zhi)量(liang)(liang)責(ze)(ze)(ze)(ze)任(ren)主(zhu)(zhu)體和主(zhu)(zhu)要(yao)責(ze)(ze)(ze)(ze)任(ren)人(ren)。對(dui)違(wei)反(fan)有(you)關規(gui)(gui)定、造成工(gong)(gong)(gong)程質(zhi)(zhi)量(liang)(liang)事(shi)故(gu)的(de),依法(fa)(fa)給予責(ze)(ze)(ze)(ze)任(ren)單位(wei)(wei)(wei)停業(ye)整頓、降低資質(zhi)(zhi)等級、吊(diao)(diao)銷資質(zhi)(zhi)證書等行政處(chu)罰并通過國家企業(ye)信(xin)用信(xin)息公示(shi)(shi)系(xi)統(tong)予以公示(shi)(shi),給予注冊執(zhi)業(ye)人(ren)員(yuan)暫停執(zhi)業(ye)、吊(diao)(diao)銷資格證書、一定時間直至終(zhong)身不得進入(ru)行業(ye)等處(chu)罰。對(dui)發(fa)生工(gong)(gong)(gong)程質(zhi)(zhi)量(liang)(liang)事(shi)故(gu)造成損失的(de),要(yao)依法(fa)(fa)追究經(jing)濟(ji)賠償責(ze)(ze)(ze)(ze)任(ren),情節嚴(yan)重的(de)要(yao)追究有(you)關單位(wei)(wei)(wei)和人(ren)員(yuan)的(de)法(fa)(fa)律責(ze)(ze)(ze)(ze)任(ren)。參與(yu)房(fang)地產開(kai)發(fa)的(de)建(jian)筑業(ye)企業(ye)應依法(fa)(fa)合規(gui)(gui)經(jing)營,提高住宅品質(zhi)(zhi)。


  (六)加(jia)強安(an)(an)(an)全(quan)(quan)生(sheng)產(chan)管(guan)(guan)理(li)。全(quan)(quan)面落實安(an)(an)(an)全(quan)(quan)生(sheng)產(chan)責(ze)任,加(jia)強施工現場安(an)(an)(an)全(quan)(quan)防護,特(te)別要強化(hua)對深(shen)基坑(keng)、高(gao)支模、起(qi)重機械等危(wei)險(xian)性較大(da)的分(fen)部分(fen)項(xiang)(xiang)工程(cheng)的管(guan)(guan)理(li),以及對不(bu)良地(di)質地(di)區(qu)重大(da)工程(cheng)項(xiang)(xiang)目的風(feng)險(xian)評估或論證(zheng)。推進信(xin)息(xi)(xi)技術與安(an)(an)(an)全(quan)(quan)生(sheng)產(chan)深(shen)度融合,加(jia)快(kuai)建設(she)建筑施工安(an)(an)(an)全(quan)(quan)監管(guan)(guan)信(xin)息(xi)(xi)系統,通過信(xin)息(xi)(xi)化(hua)手(shou)段(duan)加(jia)強安(an)(an)(an)全(quan)(quan)生(sheng)產(chan)管(guan)(guan)理(li)。建立健全(quan)(quan)全(quan)(quan)覆(fu)蓋、多層次、經(jing)常性的安(an)(an)(an)全(quan)(quan)生(sheng)產(chan)培訓制度,提升從業(ye)人員安(an)(an)(an)全(quan)(quan)素(su)質以及各方主體(ti)的本質安(an)(an)(an)全(quan)(quan)水平。


  (七(qi))全(quan)(quan)面提(ti)高(gao)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)水平(ping)。完善(shan)工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)(zhi)量安(an)全(quan)(quan)法律法規和(he)管(guan)(guan)(guan)理(li)(li)制(zhi)度(du),健全(quan)(quan)企業負責、政(zheng)府(fu)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)、社(she)會監(jian)(jian)(jian)(jian)(jian)(jian)督(du)的(de)(de)工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)(zhi)量安(an)全(quan)(quan)保(bao)障(zhang)體系。強(qiang)化(hua)政(zheng)府(fu)對工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)(zhi)量的(de)(de)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan),明(ming)確(que)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)范圍,落實監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)責任,加(jia)大抽查(cha)抽測(ce)力度(du),重點加(jia)強(qiang)對涉及公(gong)共安(an)全(quan)(quan)的(de)(de)工(gong)(gong)程(cheng)(cheng)地(di)基(ji)(ji)基(ji)(ji)礎(chu)、主體結(jie)構等(deng)部位(wei)和(he)竣工(gong)(gong)驗收等(deng)環節(jie)的(de)(de)監(jian)(jian)(jian)(jian)(jian)(jian)督(du)檢查(cha)。加(jia)強(qiang)工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)(zhi)量監(jian)(jian)(jian)(jian)(jian)(jian)督(du)隊伍建設,監(jian)(jian)(jian)(jian)(jian)(jian)督(du)機(ji)構履行職(zhi)能所需(xu)經費(fei)由同級財政(zheng)預(yu)算全(quan)(quan)額保(bao)障(zhang)。政(zheng)府(fu)可采取購買服務的(de)(de)方(fang)式,委托具(ju)備條件的(de)(de)社(she)會力量進行工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)(zhi)量監(jian)(jian)(jian)(jian)(jian)(jian)督(du)檢查(cha)。推(tui)進工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)(zhi)量安(an)全(quan)(quan)標準化(hua)管(guan)(guan)(guan)理(li)(li),督(du)促各方(fang)主體健全(quan)(quan)質(zhi)(zhi)(zhi)量安(an)全(quan)(quan)管(guan)(guan)(guan)控機(ji)制(zhi)。強(qiang)化(hua)對工(gong)(gong)程(cheng)(cheng)監(jian)(jian)(jian)(jian)(jian)(jian)理(li)(li)的(de)(de)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan),選擇部分(fen)地(di)區開展監(jian)(jian)(jian)(jian)(jian)(jian)理(li)(li)單(dan)位(wei)向(xiang)政(zheng)府(fu)報告(gao)質(zhi)(zhi)(zhi)量監(jian)(jian)(jian)(jian)(jian)(jian)理(li)(li)情況的(de)(de)試(shi)點。加(jia)強(qiang)工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)(zhi)量檢測(ce)機(ji)構管(guan)(guan)(guan)理(li)(li),嚴厲(li)打擊出(chu)具(ju)虛假報告(gao)等(deng)行為。推(tui)動發展工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)(zhi)量保(bao)險。


  五、優化建筑市場環境


  (八)建(jian)(jian)立(li)統(tong)一(yi)開放市(shi)場(chang)。打(da)破區域市(shi)場(chang)準入壁壘,取消各(ge)地區、各(ge)行業(ye)在法律、行政法規(gui)(gui)和(he)國務(wu)院規(gui)(gui)定外對建(jian)(jian)筑(zhu)業(ye)企業(ye)設(she)置的(de)不合(he)理準入條件;嚴禁擅自(zi)設(she)立(li)或變(bian)相設(she)立(li)審批(pi)、備案事(shi)項,為建(jian)(jian)筑(zhu)業(ye)企業(ye)提供(gong)公(gong)平(ping)市(shi)場(chang)環境。完善全國建(jian)(jian)筑(zhu)市(shi)場(chang)監管公(gong)共(gong)服(fu)務(wu)平(ping)臺,加快實現與全國信(xin)用(yong)信(xin)息(xi)(xi)共(gong)享平(ping)臺和(he)國家(jia)企業(ye)信(xin)用(yong)信(xin)息(xi)(xi)公(gong)示(shi)系(xi)統(tong)的(de)數據共(gong)享交換。建(jian)(jian)立(li)建(jian)(jian)筑(zhu)市(shi)場(chang)主體黑名單制度,依(yi)法依(yi)規(gui)(gui)全面(mian)公(gong)開企業(ye)和(he)個人信(xin)用(yong)記(ji)錄(lu),接受社(she)會監督。


  (九)加強承包(bao)履(lv)(lv)約管理。引導承包(bao)企業以銀行(xing)保(bao)函(han)或擔(dan)保(bao)公司保(bao)函(han)的(de)形式,向建設單(dan)(dan)位提供履(lv)(lv)約擔(dan)保(bao)。對采用(yong)常規通用(yong)技術標準的(de)政(zheng)府(fu)投(tou)(tou)資工(gong)程,在原則上實行(xing)最低價(jia)(jia)(jia)中標的(de)同時,有(you)效(xiao)發(fa)揮履(lv)(lv)約擔(dan)保(bao)的(de)作用(yong),防止惡意低價(jia)(jia)(jia)中標,確保(bao)工(gong)程投(tou)(tou)資不超預算。嚴厲查處轉包(bao)和違法分包(bao)等行(xing)為。完善工(gong)程量清單(dan)(dan)計價(jia)(jia)(jia)體系和工(gong)程造價(jia)(jia)(jia)信息(xi)發(fa)布機制,形成統一(yi)的(de)工(gong)程造價(jia)(jia)(jia)計價(jia)(jia)(jia)規則,合理確定和有(you)效(xiao)控制工(gong)程造價(jia)(jia)(jia)。


  (十)規范工(gong)程價款(kuan)(kuan)結(jie)(jie)算(suan)。審計(ji)(ji)機(ji)關應(ying)依法加(jia)強(qiang)對(dui)以政府投(tou)資(zi)為主的公共工(gong)程建(jian)(jian)(jian)設項(xiang)(xiang)目(mu)的審計(ji)(ji)監督,建(jian)(jian)(jian)設單位不(bu)(bu)得(de)將(jiang)未完(wan)(wan)成審計(ji)(ji)作為延期(qi)工(gong)程結(jie)(jie)算(suan)、拖欠工(gong)程款(kuan)(kuan)的理(li)由(you)。未完(wan)(wan)成竣(jun)工(gong)結(jie)(jie)算(suan)的項(xiang)(xiang)目(mu),有(you)關部門不(bu)(bu)予(yu)辦理(li)產(chan)權(quan)登記。對(dui)長(chang)期(qi)拖欠工(gong)程款(kuan)(kuan)的單位不(bu)(bu)得(de)批(pi)準新項(xiang)(xiang)目(mu)開工(gong)。嚴格執行工(gong)程預付(fu)(fu)款(kuan)(kuan)制(zhi)度,及時(shi)按合同(tong)約(yue)定足額(e)向承包單位支(zhi)付(fu)(fu)預付(fu)(fu)款(kuan)(kuan)。通(tong)過(guo)工(gong)程款(kuan)(kuan)支(zhi)付(fu)(fu)擔保等經濟(ji)、法律手段約(yue)束建(jian)(jian)(jian)設單位履約(yue)行為,預防拖欠工(gong)程款(kuan)(kuan)。


  六、提高(gao)從業人員素質


  (十(shi)一)加快(kuai)培(pei)養(yang)(yang)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)人(ren)才(cai)(cai)。積極培(pei)育既有(you)國(guo)(guo)際(ji)視野又有(you)民族自信的(de)(de)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)師隊伍。加快(kuai)培(pei)養(yang)(yang)熟悉國(guo)(guo)際(ji)規(gui)則的(de)(de)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)高級(ji)管理(li)人(ren)才(cai)(cai)。大力(li)推進校企(qi)合作,培(pei)養(yang)(yang)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)專(zhuan)業(ye)(ye)人(ren)才(cai)(cai)。加強工(gong)(gong)(gong)(gong)程現(xian)場管理(li)人(ren)員和(he)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)人(ren)的(de)(de)教育培(pei)訓。健全建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)職(zhi)業(ye)(ye)技(ji)(ji)(ji)能(neng)標準體(ti)系,全面實施建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)技(ji)(ji)(ji)術工(gong)(gong)(gong)(gong)人(ren)職(zhi)業(ye)(ye)技(ji)(ji)(ji)能(neng)鑒(jian)定(ding)制度。發(fa)展一批建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)人(ren)技(ji)(ji)(ji)能(neng)鑒(jian)定(ding)機構,開展建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)人(ren)技(ji)(ji)(ji)能(neng)評(ping)價(jia)工(gong)(gong)(gong)(gong)作。通(tong)過制定(ding)施工(gong)(gong)(gong)(gong)現(xian)場技(ji)(ji)(ji)能(neng)工(gong)(gong)(gong)(gong)人(ren)基本配備標準、發(fa)布(bu)各個技(ji)(ji)(ji)能(neng)等級(ji)和(he)工(gong)(gong)(gong)(gong)種的(de)(de)人(ren)工(gong)(gong)(gong)(gong)成本信息等方式,引導企(qi)業(ye)(ye)將工(gong)(gong)(gong)(gong)資分配向關鍵技(ji)(ji)(ji)術技(ji)(ji)(ji)能(neng)崗位傾斜。大力(li)弘揚工(gong)(gong)(gong)(gong)匠精神,培(pei)養(yang)(yang)高素質(zhi)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)人(ren),到(dao)(dao)2020年建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)中級(ji)工(gong)(gong)(gong)(gong)技(ji)(ji)(ji)能(neng)水平以上(shang)的(de)(de)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)人(ren)數量達(da)到(dao)(dao)300萬,2025年達(da)到(dao)(dao)1000萬。


  (十二)改革(ge)建(jian)(jian)筑(zhu)(zhu)(zhu)用工(gong)(gong)(gong)制(zhi)度。推(tui)動建(jian)(jian)筑(zhu)(zhu)(zhu)業(ye)(ye)(ye)(ye)勞務企(qi)業(ye)(ye)(ye)(ye)轉型,大力發展(zhan)木工(gong)(gong)(gong)、電(dian)工(gong)(gong)(gong)、砌(qi)筑(zhu)(zhu)(zhu)、鋼筋制(zhi)作(zuo)等以作(zuo)業(ye)(ye)(ye)(ye)為主的專(zhuan)業(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye)。以專(zhuan)業(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye)為建(jian)(jian)筑(zhu)(zhu)(zhu)工(gong)(gong)(gong)人的主要載體,逐步(bu)實現建(jian)(jian)筑(zhu)(zhu)(zhu)工(gong)(gong)(gong)人公司化(hua)、專(zhuan)業(ye)(ye)(ye)(ye)化(hua)管理。鼓勵現有專(zhuan)業(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye)進一(yi)步(bu)做專(zhuan)做精,增強競爭(zheng)力,推(tui)動形成一(yi)批(pi)以作(zuo)業(ye)(ye)(ye)(ye)為主的建(jian)(jian)筑(zhu)(zhu)(zhu)業(ye)(ye)(ye)(ye)專(zhuan)業(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye)。促進建(jian)(jian)筑(zhu)(zhu)(zhu)業(ye)(ye)(ye)(ye)農民(min)(min)工(gong)(gong)(gong)向技(ji)(ji)術工(gong)(gong)(gong)人轉型,著(zhu)力穩(wen)定和擴大建(jian)(jian)筑(zhu)(zhu)(zhu)業(ye)(ye)(ye)(ye)農民(min)(min)工(gong)(gong)(gong)就業(ye)(ye)(ye)(ye)創業(ye)(ye)(ye)(ye)。建(jian)(jian)立全國建(jian)(jian)筑(zhu)(zhu)(zhu)工(gong)(gong)(gong)人管理服務信(xin)息平臺,開展(zhan)建(jian)(jian)筑(zhu)(zhu)(zhu)工(gong)(gong)(gong)人實名制(zhi)管理,記錄建(jian)(jian)筑(zhu)(zhu)(zhu)工(gong)(gong)(gong)人的身(shen)份(fen)信(xin)息、培訓情況(kuang)、職業(ye)(ye)(ye)(ye)技(ji)(ji)能(neng)、從業(ye)(ye)(ye)(ye)記錄等信(xin)息,逐步(bu)實現全覆蓋。


  (十三)保(bao)護工(gong)人(ren)合(he)法權益。全(quan)面落實(shi)(shi)勞(lao)(lao)動(dong)合(he)同(tong)制度,加(jia)大監(jian)察力度,督促(cu)施(shi)工(gong)單(dan)(dan)(dan)位與招(zhao)用(yong)的(de)(de)(de)建(jian)(jian)(jian)筑(zhu)(zhu)工(gong)人(ren)依(yi)法簽(qian)訂勞(lao)(lao)動(dong)合(he)同(tong),到(dao)2020年基本實(shi)(shi)現(xian)勞(lao)(lao)動(dong)合(he)同(tong)全(quan)覆(fu)蓋。健全(quan)工(gong)資(zi)支(zhi)付保(bao)障(zhang)制度,按(an)照(zhao)誰用(yong)工(gong)誰負(fu)責(ze)和總承(cheng)包負(fu)總責(ze)的(de)(de)(de)原則,落實(shi)(shi)企業工(gong)資(zi)支(zhi)付責(ze)任,依(yi)法按(an)月足額發放工(gong)人(ren)工(gong)資(zi)。將存在拖欠(qian)工(gong)資(zi)行為的(de)(de)(de)企業列入黑(hei)名單(dan)(dan)(dan),對其采取限制市場準入等懲戒措施(shi),情節嚴重的(de)(de)(de)降低資(zi)質(zhi)等級(ji)。建(jian)(jian)(jian)立健全(quan)與建(jian)(jian)(jian)筑(zhu)(zhu)業相適應的(de)(de)(de)社會保(bao)險參保(bao)繳費方式(shi),大力推進建(jian)(jian)(jian)筑(zhu)(zhu)施(shi)工(gong)單(dan)(dan)(dan)位參加(jia)工(gong)傷(shang)保(bao)險。施(shi)工(gong)單(dan)(dan)(dan)位應履行社會責(ze)任,不(bu)斷改善建(jian)(jian)(jian)筑(zhu)(zhu)工(gong)人(ren)的(de)(de)(de)工(gong)作環境,提升職(zhi)業健康(kang)水(shui)平,促(cu)進建(jian)(jian)(jian)筑(zhu)(zhu)工(gong)人(ren)穩定就業。


  七、推進建筑產業(ye)現代化


  (十(shi)四(si))推(tui)(tui)廣智能和(he)裝(zhuang)(zhuang)配式(shi)建(jian)(jian)筑(zhu)(zhu)。堅持標準化(hua)設(she)計、工廠化(hua)生產、裝(zhuang)(zhuang)配化(hua)施工、一體化(hua)裝(zhuang)(zhuang)修、信息(xi)化(hua)管理(li)、智能化(hua)應(ying)用(yong)(yong),推(tui)(tui)動(dong)建(jian)(jian)造方式(shi)創新(xin),大力發展(zhan)裝(zhuang)(zhuang)配式(shi)混凝土和(he)鋼結構建(jian)(jian)筑(zhu)(zhu),在(zai)(zai)具備條件(jian)的地(di)方倡導發展(zhan)現(xian)代(dai)木結構建(jian)(jian)筑(zhu)(zhu),不斷提高裝(zhuang)(zhuang)配式(shi)建(jian)(jian)筑(zhu)(zhu)在(zai)(zai)新(xin)建(jian)(jian)建(jian)(jian)筑(zhu)(zhu)中的比例(li)。力爭用(yong)(yong)10年(nian)左右的時(shi)間,使裝(zhuang)(zhuang)配式(shi)建(jian)(jian)筑(zhu)(zhu)占新(xin)建(jian)(jian)建(jian)(jian)筑(zhu)(zhu)面(mian)積的比例(li)達到30%。在(zai)(zai)新(xin)建(jian)(jian)建(jian)(jian)筑(zhu)(zhu)和(he)既(ji)有建(jian)(jian)筑(zhu)(zhu)改造中推(tui)(tui)廣普及智能化(hua)應(ying)用(yong)(yong),完(wan)善智能化(hua)系統運行(xing)維護機制,實現(xian)建(jian)(jian)筑(zhu)(zhu)舒適安全(quan)、節(jie)能高效。


  (十五)提(ti)升建(jian)筑(zhu)(zhu)設(she)計(ji)水平。建(jian)筑(zhu)(zhu)設(she)計(ji)應體(ti)現地域(yu)特(te)征、民族特(te)點(dian)(dian)和時代風貌,突出建(jian)筑(zhu)(zhu)使用功能及(ji)節能、節水、節地、節材和環(huan)(huan)保(bao)等要(yao)求(qiu),提(ti)供功能適用、經濟合理、安全可(ke)靠、技術先進、環(huan)(huan)境協調的(de)建(jian)筑(zhu)(zhu)設(she)計(ji)產品。健全適應建(jian)筑(zhu)(zhu)設(she)計(ji)特(te)點(dian)(dian)的(de)招(zhao)(zhao)標(biao)(biao)投標(biao)(biao)制度,推行設(she)計(ji)團隊招(zhao)(zhao)標(biao)(biao)、設(she)計(ji)方案招(zhao)(zhao)標(biao)(biao)等方式。促(cu)(cu)進國(guo)內外建(jian)筑(zhu)(zhu)設(she)計(ji)企業公平競爭(zheng),培育有國(guo)際競爭(zheng)力的(de)建(jian)筑(zhu)(zhu)設(she)計(ji)隊伍。倡導開展建(jian)筑(zhu)(zhu)評論(lun),促(cu)(cu)進建(jian)筑(zhu)(zhu)設(she)計(ji)理念(nian)的(de)融合和升華(hua)。


  (十(shi)六(liu))加強技術研(yan)(yan)發應用(yong)。加快先(xian)進建造(zao)設(she)備、智能設(she)備的(de)研(yan)(yan)發、制造(zao)和推廣應用(yong),提(ti)升(sheng)各(ge)類施(shi)工(gong)(gong)(gong)機(ji)具的(de)性能和效率(lv),提(ti)高(gao)(gao)機(ji)械化施(shi)工(gong)(gong)(gong)程度(du)。限(xian)制和淘(tao)汰落后(hou)、危險工(gong)(gong)(gong)藝工(gong)(gong)(gong)法,保障生產施(shi)工(gong)(gong)(gong)安全。積極支持(chi)建筑(zhu)業科研(yan)(yan)工(gong)(gong)(gong)作,大幅提(ti)高(gao)(gao)技術創新對產業發展的(de)貢獻率(lv)。加快推進建筑(zhu)信息(xi)模(mo)型(BIM)技術在規劃、勘察、設(she)計、施(shi)工(gong)(gong)(gong)和運營維護全過程的(de)集成應用(yong),實現工(gong)(gong)(gong)程建設(she)項(xiang)目全生命周(zhou)期數據共享(xiang)和信息(xi)化管理,為項(xiang)目方案(an)優(you)化和科學(xue)決策提(ti)供依據,促進建筑(zhu)業提(ti)質增效。


  (十七)完(wan)善工程建(jian)(jian)設標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)。整合(he)精(jing)簡強(qiang)(qiang)制(zhi)(zhi)(zhi)(zhi)性(xing)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun),適度提高安全、質量、性(xing)能(neng)、健康、節能(neng)等強(qiang)(qiang)制(zhi)(zhi)(zhi)(zhi)性(xing)指標(biao)(biao)(biao)(biao)要求,逐(zhu)步(bu)提高標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)水(shui)平。積極(ji)培(pei)育團體(ti)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun),鼓勵具備相(xiang)應能(neng)力的(de)(de)(de)行(xing)業(ye)協會、產業(ye)聯(lian)盟等主(zhu)體(ti)共同制(zhi)(zhi)(zhi)(zhi)定滿足市場和(he)創新需(xu)要的(de)(de)(de)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun),建(jian)(jian)立(li)強(qiang)(qiang)制(zhi)(zhi)(zhi)(zhi)性(xing)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)與(yu)團體(ti)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)相(xiang)結合(he)的(de)(de)(de)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)供給體(ti)制(zhi)(zhi)(zhi)(zhi),增加(jia)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)有效供給。及(ji)時(shi)開展標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)復審,加(jia)快標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)修訂,提高標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)的(de)(de)(de)時(shi)效性(xing)。加(jia)強(qiang)(qiang)科技(ji)研(yan)發與(yu)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)制(zhi)(zhi)(zhi)(zhi)定的(de)(de)(de)信息溝(gou)通,建(jian)(jian)立(li)全國工程建(jian)(jian)設標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)專家委員會,為工程建(jian)(jian)設標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)化工作(zuo)提供技(ji)術支(zhi)撐,提高標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)的(de)(de)(de)質量和(he)水(shui)平。


  八、加快建筑業企業“走出去”


  (十(shi)八(ba))加(jia)強中外(wai)(wai)標(biao)(biao)(biao)準銜接。積(ji)極(ji)開展(zhan)中外(wai)(wai)標(biao)(biao)(biao)準對(dui)比研究,適(shi)應國(guo)(guo)際(ji)通行的標(biao)(biao)(biao)準內容(rong)結構、要素指(zhi)標(biao)(biao)(biao)和相關術語,縮小(xiao)中國(guo)(guo)標(biao)(biao)(biao)準與國(guo)(guo)外(wai)(wai)先進標(biao)(biao)(biao)準的技(ji)術差距。加(jia)大中國(guo)(guo)標(biao)(biao)(biao)準外(wai)(wai)文(wen)版翻譯和宣傳推(tui)廣力度(du),以“一帶一路”戰略為引領,優先在對(dui)外(wai)(wai)投資(zi)、技(ji)術輸出和援建(jian)工程(cheng)項目中推(tui)廣應用。積(ji)極(ji)參加(jia)國(guo)(guo)際(ji)標(biao)(biao)(biao)準認證、交流等活動(dong),開展(zhan)工程(cheng)技(ji)術標(biao)(biao)(biao)準的雙(shuang)邊合作。到2025年(nian),實現工程(cheng)建(jian)設(she)國(guo)(guo)家標(biao)(biao)(biao)準全(quan)部有外(wai)(wai)文(wen)版。


  (十九)提高對外(wai)(wai)(wai)承(cheng)(cheng)包(bao)(bao)(bao)能力(li)。統(tong)籌(chou)協(xie)調建(jian)筑(zhu)業(ye)“走出(chu)去”,充分發揮我國建(jian)筑(zhu)業(ye)企(qi)業(ye)在(zai)高鐵、公路(lu)、電力(li)、港(gang)口、機場(chang)、油氣長(chang)輸管(guan)道、高層建(jian)筑(zhu)等(deng)工(gong)(gong)程(cheng)建(jian)設(she)方面的比(bi)較優勢,有目(mu)標、有重點、有組織(zhi)地(di)(di)對外(wai)(wai)(wai)承(cheng)(cheng)包(bao)(bao)(bao)工(gong)(gong)程(cheng),參與(yu)“一(yi)帶一(yi)路(lu)”建(jian)設(she)。建(jian)筑(zhu)業(ye)企(qi)業(ye)要加大(da)對國際(ji)標準(zhun)的研究(jiu)力(li)度,積極(ji)(ji)適應國際(ji)標準(zhun),加強對外(wai)(wai)(wai)承(cheng)(cheng)包(bao)(bao)(bao)工(gong)(gong)程(cheng)質(zhi)量、履約(yue)等(deng)方面管(guan)理,在(zai)援外(wai)(wai)(wai)住房(fang)等(deng)民(min)生項目(mu)中發揮積極(ji)(ji)作用。鼓勵大(da)企(qi)業(ye)帶動(dong)中小(xiao)企(qi)業(ye)、沿(yan)海(hai)沿(yan)邊地(di)(di)區企(qi)業(ye)合作“出(chu)海(hai)”,積極(ji)(ji)有序(xu)開拓國際(ji)市(shi)場(chang),避免(mian)惡性競爭。引導對外(wai)(wai)(wai)承(cheng)(cheng)包(bao)(bao)(bao)工(gong)(gong)程(cheng)企(qi)業(ye)向項目(mu)融(rong)資(zi)、設(she)計咨詢、后續運營維護(hu)管(guan)理等(deng)高附加值的領域(yu)有序(xu)拓展。推動(dong)企(qi)業(ye)提高屬(shu)地(di)(di)化(hua)經營水平,實(shi)現與(yu)所在(zai)國家和地(di)(di)區互利共贏。


  (二十(shi))加大政策(ce)扶持力度(du)。加強(qiang)建筑(zhu)(zhu)業(ye)“走出(chu)去”相關主管部(bu)(bu)門間的溝通協調和(he)信息(xi)共(gong)享。到2025年,與大部(bu)(bu)分“一帶一路”沿線國家和(he)地區簽訂雙邊工(gong)程(cheng)建設合作(zuo)備(bei)忘(wang)錄,同時(shi)爭取在雙邊自貿協定中納(na)入(ru)相關內(nei)容,推進建設領(ling)域執業(ye)資格國際(ji)互(hu)認。綜合發揮各類金融(rong)工(gong)具的作(zuo)用,重點支(zhi)(zhi)持對外經濟合作(zuo)中建筑(zhu)(zhu)領(ling)域的重大戰略項(xiang)目(mu)。借鑒國際(ji)通行的項(xiang)目(mu)融(rong)資模式,按照(zhao)風險可(ke)控、商業(ye)可(ke)持續原(yuan)則,加大對建筑(zhu)(zhu)業(ye)“走出(chu)去”的金融(rong)支(zhi)(zhi)持力度(du)。


  各地(di)區(qu)、各部門要高(gao)度重視深(shen)化建(jian)(jian)筑業(ye)(ye)(ye)(ye)改(gai)革(ge)工作,健全(quan)工作機(ji)制,明確任(ren)務分工,及時研究解決(jue)建(jian)(jian)筑業(ye)(ye)(ye)(ye)改(gai)革(ge)發(fa)(fa)展中的(de)重大問題,完(wan)善相關政策,確保按(an)期完(wan)成各項改(gai)革(ge)任(ren)務。加(jia)快(kuai)推動修(xiu)訂建(jian)(jian)筑法(fa)(fa)(fa)、招標投標法(fa)(fa)(fa)等法(fa)(fa)(fa)律(lv),完(wan)善相關法(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)規(gui)。充分發(fa)(fa)揮(hui)協會商會熟悉(xi)行(xing)業(ye)(ye)(ye)(ye)、貼近企業(ye)(ye)(ye)(ye)的(de)優勢,及時反(fan)映企業(ye)(ye)(ye)(ye)訴求(qiu),反(fan)饋政策落(luo)實情況,發(fa)(fa)揮(hui)好(hao)規(gui)范(fan)行(xing)業(ye)(ye)(ye)(ye)秩序、建(jian)(jian)立從(cong)業(ye)(ye)(ye)(ye)人員行(xing)為準則、促進企業(ye)(ye)(ye)(ye)誠(cheng)信經營(ying)等方(fang)面的(de)自律(lv)作用。
